Terms of Service

1. These terms

These terms are an agreement between you and Q Creatives (“Pixigns”, “we”, “us”), which runs Pixigns. They cover this website, the Pixigns app, and the software on Pixigns players (together, “Pixigns”). By using Pixigns you agree to them. If you use Pixigns for a business, you agree to them for that business and confirm you're allowed to.

Our Privacy Policy explains how we handle personal information.

2. Your account and your team

• Give us a real email address you check. We use it to sign you in and to reach you about your account.
• Keep access to that email, and to your Google account if you sign in with it, secure. Tell us straight away if you think someone else has used your account.
• You're responsible for the people you invite to your business and for what they do in it.

3. Plans and billing

• The Free plan costs nothing and covers one screen. Paid plans and their prices are on our pricing page.
• Paid plans are charged per screen, in US dollars, in advance, monthly or yearly. Stripe handles payment.
• Paid plans renew automatically at the end of each period until you cancel.
• When you add screens partway through a period, you're charged for the rest of that period, in proportion.
• Prices don't include taxes, which are added where they apply.
• If we change a price, we'll tell you at least 30 days before it applies to your next renewal.
• If a payment fails and isn't fixed, your business moves to the Free plan. We won't switch your screens off because of a plan change.

4. Cancelling and refunds

• You can cancel a paid plan any time from Billing in the Pixigns app, or by emailing support@pixigns.com. It stays active until the end of the period you've paid for, then doesn't renew.
• We don't give refunds or credits for partial periods, unused screens, or moving to a smaller plan, except where the law requires it.
• Deleting your business ends its subscription immediately, without a refund for the rest of the period.

5. Players

• If you buy a Pixigns player from us, its price, shipping, returns and warranty are the ones stated when you order. Once it's paid for, it's yours.
• Players update their software automatically, so they stay secure and keep working with Pixigns. They only install updates we have signed. Please don't interfere with updates or modify the player's software.

6. Your content

You own what you put on Pixigns: your photos, videos, music, menus and everything else (“your content”). You give us permission to store, copy, process and show your content only as needed to run Pixigns for you, including on your screens and in backups.

You're responsible for your content and for having the rights to use it. That includes licences to play music in your business, which a personal music subscription usually doesn't cover, and making sure prices, offers and allergen information are accurate.

7. What you can't do

Don't use Pixigns to:

• show anything illegal, or anything that infringes someone else's rights;
• show content that is deceptive, harassing, hateful, or sexually explicit;
• spread malware, or try to get into accounts, businesses or systems that aren't yours;
• overload, disrupt, or work around the limits of Pixigns, or copy or reverse-engineer it;
• resell Pixigns without our written permission.

8. AI features

Some features use AI, for example to read a menu from a photo or make an image. AI can get things wrong, so check what it makes, especially prices, ingredients and allergens, before you publish. What you give these features is sent to AI model providers to produce the result, as our Privacy Policy describes.

9. Other services

When you connect Google, Canva or YouTube, or pay through Stripe, their own terms also apply to your use of them. We aren't responsible for those services.

10. Keeping things running

We work to keep Pixigns available, and players keep playing what they've downloaded when the internet drops. We back up every business daily. Still, no service is perfect: we can't promise Pixigns will always be available or free of errors, so keep your own copies of your original files.

We may change or improve Pixigns over time. If we remove something important from a paid plan, we'll tell you first.

11. Suspending or ending your use

We may suspend or close an account that breaks these terms, puts Pixigns or other people at risk, or isn't paid. Where we reasonably can, we'll warn you first and give you a chance to fix it. You can stop using Pixigns and delete your business at any time. What happens to your data then is in our Privacy Policy.

12. Disclaimer

Pixigns is provided “as is” and “as available”. As far as the law allows, we make no warranties beyond those in these terms, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limits on liability

As far as the law allows, we aren't liable for indirect or consequential losses, such as lost profits, lost revenue or lost data. Our total liability for any claim about Pixigns is limited to what you paid us in the 12 months before the claim, or US$100 if that's more.

14. Claims about your content

If someone makes a claim against us because of your content or your breach of these terms, you agree to cover our reasonable costs of dealing with it, including legal fees.

15. Governing law

These terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. Any dispute will be heard in the state or federal courts in King County (Seattle), Washington, and you and we both agree to those courts.

16. Changes to these terms

We may update these terms. We'll change the date at the top and, for changes that matter, email business owners at least 30 days before they take effect. If you keep using Pixigns after that, the new terms apply.

17. The rest

If part of these terms can't be enforced, the rest still applies. If we don't enforce something straight away, we can still enforce it later. You can't transfer these terms to someone else without our agreement; we may transfer them as part of a sale or merger of our business.
